When I took a Communications Law course during my run-up to gradate work in Journalism, I found an entire lexicon of words that seemed familiar but had different meanings; other words were entirely foreign to me. Most youngsters do not think about insurance; hence, the lack of familiarity with indemnity. Professor Molenkamp responded to my query for more information about how the word works in his field. He recommended Blacks Law Dictionary for a definitive answer, but added: he LawDictionary.org defines “indemnify” as “[t]o save harmless; to secure against loss or damage; to give security for the reimbursement of a person in case of an anticipated loss falling upon him. Also to make good; to compensate; to make reimbursement to one of a loss already incurred by him.” In my world, the word comes up largely in two contexts:   First, with respect to principal/agency relationships where the principal agrees to indemnify the agent for his or her activities.   Thus, a corporation will generally agree to indemnify corporate officers for their actions, as long as they are not in violation of the law.   Second, with respect to merger and acquisition transactions, where the seller agrees to indemnify the purchaser for a breach of the seller’s representations or covenants. Variations of the word are used as other forms of speech:   thus, indemnity or indemnification, as nouns.   In addition, the one who gives an indemnity (or who agrees to indemnify) is the indemnitor; the recipient, the indemnitee. The OED looks back as far as the 17th Century for earliest recorded uses, and they describe situations involving financial protection against possible future damages or injury: there we have the modern association with insurance. But the same definition includes more, to secure against legal responsibility for past or future actions or events. When you sign a waiver for that white-water rafting or at the gun range, the proprietors have used that document in this sense. Of course, they have insurance as well! No usage in the OED dates later than the end of the 19th Century. I suppose that is a good thing: legal definitions should remain stable for a long time. The Nature and Status of Folk Psychology Free Essays

The nature and status of Folk Psychology (UP) In philosophy circles is controversial. In this essay I shall begin by briefly defining what folk psychology Is. Followed by an outline on eliminative where some of the controversy lies. Folk psychology (UP) is the name given by lamentableness to the common sense understanding of the mind (Mind and Bodies pep). A common sense view which accepts that we all have desires and emotions such as fear, lust, beliefs, desire, pain, pleasure ,love, hate, joy attraction and so forth. These deferent states of being are utilized in what are called propositional attitudes which show intent. An example of a propositional attitude is Brenda ‘believes’ she can win the lottery, Hereford ‘believes’ is the Intentionality in this propositional attitude. The view of UP encapsulated by Paul Churchyard Is that It â€Å"embodies our baseline understanding of the cognitive, affective, and purposive nature of person. Considered as a whole, it constitutes our conception of what a person is†. (Churchyard in Guatemalan, 1994, p. 08) Before we go on to examine Churchyards criticism of UP, I think it would be useful to give a brief overview of the eliminations viewpoint regarding UP. Eliminative materialism (also called eliminative) Is a materialist position in the hilltop’s of mind. Its primary claim is that people’s common-sense understanding of the mind (or folk psychology) Is false and that certain classes of mental states that most people believe in do not exist (Wilkinson, Mind and Bodies pep) Paul M. Churchyard (b. 942) a Canadian-born philosopher is a leading proponent of eliminative; he is a long time critic of UP and the foremost advocate of neuroscience. Churchyards criticism dovetails with the eliminations claim that UP is a false theory â€Å"Eliminative materialism is the thesis that our common-sense inception of psychological phenomena constitutes† (eliminative Materialism and the Propositional Attitudes’ Paul M Churchyard Reading 6, Wilkinson, Mind and Bodies p 194). He claims that UP is not only a radically false theory but also an empirical theory by pointing out Its similarities with other theories. He does this by stating how our â€Å"familiar mentalist vocabulary’ is to be understood like other semantic terms. In that the terms used need or in fact do operate by a network of formulate laws like any other theory. An example of how Churchyard employs UP as theory Is found In his hypothesis argument on understanding the minds of others. He says that we can use UP as a hypothetical framework which Works in the main and is reasonable’ to employ (Wilkinson, Mind and Bodies pep). Although Churchyard accepts our everyday use of UP as a reasonable thing to do he still argues forcefully his claim, that UP is a false theory and does this with a three pronged attack: – (a) its ontology is an illusion, (b) It is a stagnant theory and incapable of advance (c) It Is not reducible to neuroscience. (a) Churchyard begins his attack on UP by declaring that It ouch as mental illness; imagination; intelligence differences; sleep issues; motor co- ordination; perceptual illusions and memory, that he claims UP has nothing to say. He includes learning in this critique and with a further assault on UP propositional attitudes, questions where they are stored and how they are learnt to be employed, both vital to UP views on the conception of the mental. However Churchyard does not go as far as to say UP is not true but rather illusionary and that â€Å"UP is at best a highly superficial theory’ (Ibid IPPP up 16) (b) Churchyard argues on historical grounds that The UP story is one of retreat infertility and decadence† (Ibid IPPP IPPP). He gives the example of how early man used UP to relate to their environment in a naive fashion believing that the wind was capable of anger, the moon Jealousy as examples of early intentional attitudes. Therefore backing up his argument that UP along with these historical intentional attitudes has become stagnant and sterile and had to give ground in the face of better theories from the area of empirical science (Wilkinson Mind and Bodies pep). To add further weight to this criticism Churchyard uses Mire Legatos’ terms that â€Å"UP is a stagnant or degenerating research program, and has been for millennia† (Churchyard, Reading 6, Wilkinson, Mind and Bodies, IPPP, up 18). (c) Theoretical reductionism, the process by which one theory is absorbed into another is what Churchyard uses as the main thrust of his argument that UP is probably false as it is not reducible to neuroscience. How UP promises theoretical integration by Churchyard’s opinion is very poor he bashes FPS lack of progress and coherence in relation to natural history and physical sciences. Where he believes there growth in rinsing understanding of man is out performing UP in many respects, pointing to neuroscience breakthroughs in human sensory input and neural activity. Furthermore according to Churchyard, UP is akin to a misfit standing alone looking incapable of synthesis as FPS â€Å"stagnation and explanatory impotence promise little faith† (Ibid IPPP IPPP). Moreover UP will not likely be reflected by neuroscience as it will seem to be antiquated and here he draws a parallel between UP and ‘Aristotelian cosmology. His final and most damming attack to back up his arguments on FPS laziness is that it â€Å"suffers explanatory failures on an epic scale† (Ibid, IPPP, IPPP). I will now go over the main points of Churchyards arguments and challenge their validity and soundness in the light of his main critics and defenders of UP. Churchyards first criticism that there are areas of the mind such as motor co- ordination, sleep and memory which he says are not dealt sufficiently by UP. And implying that its ontology may be false is objected to by a riposte from two American philosophers Horror and Woodward in defense of UP. Firstly on the grounds that to impose demands on any psychological theory accounting for considerable know how when theoretical knowledge is relatively primitive (A fair point given that psychology as a medical discipline has only been practiced about the last one hundred years). Secondly, as Churchyard argues if UP is to be a successful theory the fact it must offer explanations for all the phenomena it lists in Horror and Woodward opinion this argument needs to be treated with skepticism and caution (Horror and Woodward, 1985, up. 00). Finally as Churchyard’s narrowing of FPS definition does not cover retain areas of the mind it is also dismissed, with good argument I think, because cognitive psychology has developed detailed theories on intentional psychologies (UP) Churchyards empirical argument fails to provide a convincing critique on the grounds that the theories outlined are explainable in terms of UP. Churchyards second assault on UP that it is a stagnant theory emplo ying the same mentalist framework as the ancient Greeks. Horror and Woodward have a counter argument they rebut his view by citing the progression in 18th and 20th century literature such as Jane Austin and John Birth. Furthermore bringing their point to bear with great assurance when they point to the modern day skill in appealing to our â€Å"unconscious beliefs and motivations†, in my view borne out when viewing our modern day advertising. Therefore a rebuttal to Churchyards assertion that UP is a stagnant theory, incapable of advance is found to be false (Wilkinson, Mind and Bodies pep). In reply to Churchyards controversial damning conclusion on FPS falseness due to its inability to reduction and that it â€Å"suffers explanatory failures on an epic scale† (Reading 6 IPPP,IPPP), American philosopher Daniel Detente (1942) points out hat eliminations fails to recognize UP as a ‘normative’ theory (not Just a descriptive one). In that it also encapsulates an ‘ideal’ or recommendation on how to proceed as a rational being with a value structure which incorporates social practices, such as greeting, reassuring, that is relevant to everyday existence. A pertinent point made by Denned in that it is not Just crucial not only to our own reason as human beings but that it enables us to act and think rationally and facilitates good social relations. This as can be deduced makes a mockery of Churchyards FPS falseness claims. These thoughts are mirrored by Horror and Woodward that UP although probably not reducible to neuroscience â€Å"Churchyard is Just mistaken to assume that UP must be reducible to neuroscience in order to be compatible with it† (Horror and Woodward, 1985, PEP). The assessment and examination of eliminations views on Folk Psychology with particular regard to Churchyards criticisms and UP defenders crystallites for me the essence of the UP debate, theory or practice? , reality or illusion? , past or future? UP for me is a skill nurtured by the past and in my opinion elegantly defended by Horror and Woodward arguments not only for its continual relevance but its reliance upon contemporary culture implying a growth in its lexicon. Finally Dent’s utter dismissal of the eliminations views that UP left a great deal unexplained. And it is by Dent’s assertion that we need UP to give us a language of reason for both our personal and social behaviors, a real boon to Folk psychology. After defining and outlining both UP and eliminative, we can see some plausible solutions to the controversy with regards to the claims that UP is a false theory, Rutherford that it is illusory, stagnant and non reducible. In my opinion Churchyard’s assertion that UP is a false theory is invalid. As having seen the arguments for criticizing UP I have come to the view that Churchyard’s criticisms of UP can easily be argued against, not because of his limitations of his understanding but because of his not taking into account ‘normative’ values pointed out by Denned. But also invalid on the grounds that at least two to three thousand years in the life of mankind would be in my view absurdly dismissed. Marijuana has well-organized supporters who campaign for its legalization and promote its use through books, magazines, and popular music. They regard marijuana as not only a recreational drug but also a form of herbal medicine and a product with industrial applications. Marijuanas opponents are equally passionate and far better organized. They consider marijuana a dangerous drug-one that harms the users mental, physical, and spiritual well being, promotes irresponsible sexual behavior, and encourages disrespect for traditional values. Many famous and credible people such as Abraham Lincoln and Albert Einstein have found the holes in prohibition laws and pointed out the disadvantages of this type of government. The most powerful of these is the way that the PSA tugs upon the emotions of the viewer. This is affected by representing situations in a seemingly normal way; however, through utilizing sinister motives, references to the prior attacks of September 11th, the way in which our current world has changed, and the strong and ever-present feeling that there is something lurking beneath the surface, the PSA is able to engage the emotions of the viewer in a way that would otherwise not be possible. Moreover, by using images and slight of hand camera work that tells a story within a story which ultimately has a connection to a larger story (terrorism), the viewer is even further engaged as to the means whereby they can stand to affect a difference on this action being perpetrated within the world in which they live. This is interesting and powerful due to the fact that the PSA does not make any mention of a particular time or place. They also vote just like the other races and can join and serve in the military or police. Studies show that most Native Americans in the United States are still trying to cope with adjustment of civilization and belong to all economical classes from the most primitive to the most sophisticated. Majority of Native Americans have adapted modernity and face the risk of becoming endangered. This is because the children of the Native Americans fail to learn their native language, leading to death of the languages. According to the 2008 census 70 percent of Native Americans live in the urban areas and like to be identified by their tribes such as Cherokee, Beothukm, Inuit, Hawaiian, and Cree Indian among others. Many of them like speaking their languages or maintain their practices even if they are thousands of miles away from their homelands (Carney 2 8). The largest Native American tribe according to the 2006 census was the Cherokee with a population of 331,000, followed by Navajo with 230,000. The economy of the Natives ranges from good to worst, a few have made it affluence particularly those who have utilized natural resources in their lands and those who trade oil and run casinos. The rest of thousands of Native Americans are still in poverty and survive on hunting and small-scale farming (Bright 77). They live at starvation levels and the government of the United States provides aid to support them. The 2006 census shows that the median annual income of a Native American’s household by was $33,132. The revenues of their businesses in 2002 amounted up to $26.4 billion. Implementing Effective Job Delegation in the Units Essay

As a supervisor on our medical surgical unit, our hospital patient satisfaction scores for the past two years have been going down and there is a great need to improve patient satisfaction scores, particularly in the area of effective job delegation. Research (2011) has shown that a leader who does not delegate might likely feel stressed and overloaded. Although it might seem the best way for work to get done, is to do it yourself, but it’s not a good long-term solution. Feedback and review remain helpful and important, although the relationship is more likely one of mentoring, rather than coaching. The Question In order to improve patient satisfaction score in hospitals, the first question that health care providers should ask is what can be done to improve the quality of care given to our patients, and the second question is, how can effective job delegation improve our patient satisfaction score in our hospital? Will the creation of a policy on implementation of effective job delegation, encourage collaboration between the nursing staff and personnel to ensure that all personnel are not stressed or overworked? On our medical surgical unit, nurses struggle to deliver all the care their patients need, but are unable, due to stress and overwork. Good delegation saves time, develops people, grooms a successor, and motivates. Poor delegation will cause frustration, discouragement and Confusion, as such the delegated person will fail to carry out the delegated task. Effective job delegation will improve our patient satisfaction scores, even if most nurses would prefer to deliver all the care their patients need, but can’t, due to overwork and stress. The delegated task may be small, but has a large overall impact for all those involved. Nursing is a demanding profession, often nurses feel as though there are not enough hours in the day to complete all tasks, delegation of job will help nurses complete all the jobs allocated, this will help improve patient’s satisfaction scores. In the medical field today there is shortage of nurses, but still nurses are still expected to provide safe and effective care for their patients, by elegating some aspects of care to others this goal can be archived. Evidenced-Based Studies Many studies have been performed on effective job delegation. An article by American Nurses Association: Research and expert opinions suggest that effective job delegation frees up Nurses to do what they have been educated to do and coordinate patient care (ANA, 2020). It explained that delegating jobs help improve collaboration between healthcare workers, by delegating some aspects of care to others. Another article in the ADVANCE web site published by trustworthy researchers, who did the research on: why it is significant for healthcare workers to delegate job: since they decided what patient care intervention is necessary and how, when, and by whom these interventions need to be provided. The article narrated how effective job delegation will improve patient satisfaction scores; though most nurses would prefer to deliver all the care their patients need (Juno, 2010). An advanced research was carried out by nursing expert, who explained, that effective job delegation will improve patient satisfaction scores due to nurses shortage and the need to lower medical cost. The article describes how good job delegation saves time, develops people, grooms a successor, and motivates workers, while Poor job delegations causes frustration and overwork to nurses, making the task of healthcare workers difficult to give safe healthcare to their patients ( Juno, 2010). It explained that delegating jobs help improve collaboration between workers. An international research in South Africa discovered that there is a large disparity in service levels workload, between private and public sectors. The research point out that effective job delegation is necessary for both private and public sectors for jobs to be carried out efficiently (AFN, 2012). The organization Advocate for Nurses carries out a research and found out that the provision of health care in America has been compromised by the loss of trained health workers due to over work and stress, the article explained that when Managers or leaders engage in effective job delegation in the health care organization, Nurses will not leave the profession because of overwork and stress. It explained that poor job delegation lead to pressure and work overload, because most nurses think they can provide all the care their patient need, which is impossible to do, as such leaving one tressed, unhappy, and feeling that you’re letting your profession down, the solution to prevent this feeling is effective job delegation (AFN, 2012). They also explained why health care worker have to delegate, because of changes in healthcare delivery, they stressed the fact that task delegation is here to stay at least for the foreseeable future. Job delegation is crucial to cost containment a nd Job delegation is important; as such health care professionals should take it as an expected professional nursing activity (AFN, 2012). The Proposal The outcome of creating a policy is something that is realistically obtainable in a professional practice: Access to the hospital policies, meeting with floor managers/unit leaders and Identifying problems in our hospital have shown that our nurses and managers are stressed and overworked. The task of a competent manager is not to do all the work on his or her own, but to smartly deliver within the given parameters of budget and timeline I propose that all managers must make sure that the delegated person understands the importance of the task, the responsibility it brings and the long-term consequences. Once they are clear about the task it becomes easy for the job to be accomplished. Managers should make sure, those who are delegated, feel they are contributing to the success of the organization rather than standing on the periphery, and they must ensure that the job being delegated is handed to the appropriate individual, because if the task is not done, the person who delegated the job as well as the delegated person are responsible for non-performance of the job. Delegation is transferring a competent individual the authority to perform selected tasks in a selected situation. Effect job delegation facilitates success and trust among nurse, who then be able to deliver safe and satisfactory care of patients, as a result improve patient’s satisfaction scores. Conclusion Effective delegation involves achieving the desired results, managing the demanding deadlines, empowering and equipping the team. Ultimately, the responsibility of getting delegated job accomplished remains with the manager. Researchers have shown that leaders who do not delegate feel stressed and overloaded with work. Good delegation saves time, develops people, grooms a successor, and motivates. Poor delegation will cause frustration, discouragement and confusion. Steve Glansburg English 123-33 Professor Orszulak October 18th, 2010 â€Å"To abort or to not abort; That is the question† Abortion is one of the most debated topics in the United States today. Many people form their opinions on their already religious beliefs and morals. Right now in the United States, it is legal everywhere to perform an abortion. Abortion can be done at many different stages of the pregnancy and most people’s opinion on abortion differs with their thoughts of when during the pregnancy should it be ok to abort.I believe that abortion should always be legal because no one person has the right to tell a woman that she must have a child, even if it was a mistake. Accidents happen whether it be the condom tears, the birth control does not work, or even the rare cases where a woman gets pregnant without actually having sex. We are human beings, we are not perfect in anyway shape or form, we are bound to make mistakes and I don’t believe that this ki nd of mistake should automatically change your life without giving you an option if it does.I can see where people could get upset from someone performing an abortion when you can actually see fetus, but I don’t see where they could get upset when the egg is just fertilized or is just a collection of cells. One human being has over 50 trillion cells in their body and you shouldn’t get mad if a woman decides to kill about 100 of them (Human Body). That is my viewpoint; women should be allowed to get an abortion before a certain time in the pregnancy. I don’t view a collection of cells that is not any type of developed organism yet to be a living person.There are also other circumstances that I believe make abortion a valid choice for a woman. Rape is a horrific event that no woman chooses to have done to her and I don’t believe they should also have to be pregnant from it too. If I was a woman and I was raped and became pregnant, but was not allowed to hav e an abortion, I would be furious. â€Å"I would feel that I did not choose for this to happen to me, it was violently forced upon me and I think that should be enough punishment. I also would not want to have a child that has the mixture of DNA from myself and the man who raped me and scared me for life. Also when a woman is not fit to become pregnant I don’t believe that they should be forced into maintaining the pregnancy if they made a mistake. If a woman is too young, is not financially stable, or has a drug problem are all valid reasons to not stay pregnant. Becoming pregnant at a young age can honestly ruin your life and make it so you can never go back to the way things were and fulfill your dreams that you once had.Not being financially stable to support a child is also a big problem because every child deserves to have a safe and healthy childhood. Having a drug addiction really is a problem because addicts will not stop during that nine months that they’re pregnant and that can severely compromise the health and wellbeing of the growing fetus. Abortion is a very debated topic because of all the moral and ethnic ties that come with it. Everyone has different belief systems and family upbringings that make it so their viewpoints are their very own.All I can argue is that not everyone chooses to become pregnant and that is why I don’t believe people should not have the choice to not stay pregnant, because in the end the woman has the right to do what she wants with her own body. Globalization has an impact both on a relatively small food industry as Hansens Natural and a relatively big food industry as Kraft Foods. Hansen’s Natural Corporation develops, markets and distributes wide assortment of beverage products. It operates in the US. Kraft Foods manufactures, markets and packages food and beverages. It’s the largest packaged foods company in North America and second largest in the world, behind Nestle. The internet and IT has created a great opportunity for both companies, Kraft and Hansen, to provide information education on the benefits of their products to their current customers as well as their potential customers. It has broadened the scope of advertisement across the globe. Worldwide access to Hansen’s generic products is poor as compared to Kraft Foods, its competitor. Globally, Hansen’s products could only be purchased online through Amazon, purchase should be greater than $25, or through CCE, which supplies US, Canada, UK and certain other countries in Europe, whereas Kraft Food has a strong global distribution network. In North America, Kraft performs direct store delivery and warehouse deliveries, across 139 distribution centers and depots. Outside North America, warehouse delivery and services with independent sales offices and agents is done across 97 distribution centers and 29 countries. This makes Kraft Food’s generic products easily accessible worldwide as compared to Hansen’s Natural.
